1. HOW TO ENTER
a. The KYKY Y98 – ‘vitaminwater®/Aces Giveaway’ (the “Contest”) will begin on Monday, June 30, 2008 at 12:01am CST and end on Friday, July 25, 2008 at approximately 5:00 pm CST (the “Contest Period”).
b. To participate in the Contest, you may enter via the following methods: beginning on Monday, June 30, 2008 at 12:01am CST, log on to www.straubs.com and click on the “enter here” link on the home page which will take the user to www.Y98.com. Or, log directly into the www.Y98.com website and join the Y98 Free Stuff Club or log-in to your account in the Y98 Free Stuff Club. If you are registering for the first time, you must provide your first name, last name, email address and zip code. Once logged in to the Y98 Free Stuff Club, click on the St. Louis Aces vitaminwater® icon. Enter your first name and last name, complete address, city, state, zip code, home telephone number and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. For purposes of these Official Rules, “receipt” of an online entry will be solely determined when the www.Y98.com web server records the entry information. Any automated computer receipt (such as one confirming delivery of e-mail) does not constitute actual receipt of an entry form for purposes of these Official Rules. KYKY’s computer is the official time keeping device for this Contest. All entries submitted become the some property of KYKY and will not be acknowledged or returned. Multiple participants are not permitted to share the same e-mail address. Use of any device to automate entry is prohibited. All entries must be received by Friday, July 25, 2008 @ by 5:00 pm CST.
c. KYKY is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all persons who are 18 years of age or older at time of entry and who reside in a county which is part of the St. Louis Total Survey Area, as defined by Arbitron. Employees of KYKY (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the St. Louis metropolitan area and the members of their immediate families and households are ineligible to participate or win.
b. Listeners are eligible to win a Station contest only once every sixty days unless the prize is valued at $600 or more then, only once every six months. Only one winner per household is permitted in any contest.
c. Winners must provide government issued photo ID and sign and return any required Affidavit of Eligibility and/or Publicity/Liability Release.
d. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. One (1) first prize and one (1) grand prize will be awarded.
i. The first prize consists of a six (6) month supply of vitaminwater® (8 cases of various flavors of vitaminwater®. Winner can pick it up the entire supply all at once at the radio station) and one (1) St. Louis Aces sweatshirt, sponsor-specified size. Approximate Retail Value =$175.00
ii. The grand prize consists of a six (6) month supply of vitaminwater® (8 cases of various flavors of vitaminwater®. Winner can pick up the entire supply all at once at the radio station), Two (2) Season tickets to St. Louis Home Matches in 2009 between July 3 and 28, 2009 (not responsible if any of the Home Matches are cancelled, delayed, postponed and winner will not be reimbursed for tickets, unless issuer reimbursed according to its standard raincheck policies), one (1) St. Louis Aces t-shirt (size to be determined when winner is announced), and one tennis racquet (Wilson K Pro Open). ARV = $775.00. Winner and guest are subject to all applicable terms and conditions and restrictions of the prize provider.
b. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. All winners of gift certificates, passes, vouchers, etc. will be subject to the terms and conditions as set forth by the prize provider. Other restrictions may apply.
c. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of Station management with respect to the contest are final.
b. On Monday, July 28th, 2008 at 5:00 pm CST, one (1) first prize winner and one (1) grand prize winner will be selected in a random drawing from all eligible entries received.
c. Odds of winning will depend upon the number of eligible entries received.
d. Winners need not listen or be present to win.
e. Winner(s) will be contacted by telephone and/or email following the drawing. If the winner cannot be contacted within three business days, the prize will be forfeited and an alternate winner will be selected in a random drawing from the remaining entries received, time permitting.
f. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within thirty (30) days of notification attempt or prize will be forfeited. No alternate winner will be chosen.
5. CONDITIONS
a. Payment of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the Contest, winner and his/her guest agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require the winner and his/her guest to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, prize providers and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
h. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of Y98, 3100 Market Street, St. Louis MO 63103.
